VA Finally Ends Policy That Stripped Vets of Their Gun Rights Without Due Process

The Department of Veterans Affairs today announced a major new step to protect Veterans’ Second Amendment rights. Effective immediately, VA will not report Veterans to the Federal Bureau of Investigation’s National Instant Criminal Background Check System as “prohibited persons” only because they need help from a fiduciary in managing their VA benefits.

This corrects a three-decade-old wrong that deprived many thousands of Veterans in VA’s Fiduciary Program of their constitutional right to own a firearm without a legal basis.

After a thorough review, VA recognized that many Veterans had been deprived of their Second Amendment rights without hearings or adequate determinations that they posed a sufficient risk of danger to themselves or others. In consultation with the Department of Justice, VA has determined this practice violates both the Gun Control Act and Veterans’ Second Amendment rights. According to federal law, a decision by a judicial or quasi-judicial body is needed before someone can be reported to NICS.

A determination by the VA that a fiduciary is needed to help manage a Veteran’s VA benefits falls far short of this legal standard.

  2. And what compensation for these veterans for decades of intentional and illegal and unconstitutional deprivation of rights, literally under color of law?

    1. This was started by Clinton, a democrat. Looking back over history, the democrats for the last 60 years, at least, have a pretty solid track record of anti-veteran activity to deny veterans something in some way.

      More recently, just this past week, the democrats went after VA disability pay for veterans. Trying to change the rules for how veterans are rated. They tried to get a rule change into the federal register where it would automatically take effect. No notice, no public announcement, no comment period is required for VA rule changes, it just has to be published in the federal register to take effect. And they did. But it was stopped from taking effect permanently by veterans and veterans organizations by having republican representatives invalidate the rule change and start actions to remove it.

      Democrats are always trying these anti-veteran sneaky back door tactics in comitties. Doing things like this where it doesn’t get noticed until its too late or at all but has a very big effect on veterans.

  4. Ok, …tarrifs. SCOTUS in Learning Resources, Inc., et al v. Trump, ruled (6-3) that Trump’s invocation of the International Emergency Economic Powers Act (IEEPA) to enact tariffs on foreign goods coming into the United States is unlawful.

    Does this mean Trump, as president, does not have tariff authority? No, it doesn’t. It just means he doesn’t have it under the IEEPA, but does this mean those tariffs are going to go away and are no longer valid? No, not at all. Congress can ‘delegate/enable’ tariff powers to the president, they just didn’t do it under the IEEPA but they had already done it in the past under other statutes. And indeed some of the tarrifs Trump imposed were already under these other statutes (and not in contention in the SCOTUS case) and not under the IEEPA and will remain in place, its just the ones done under the IEEPA that will be ‘re-designated’ to fall under the other statutes.

    In …. The Trade Expansion Act of 1962 (Section 232); the Trade Act of 1974 (Sections 122, 201, and 301); and the Tariff Act of 1930 (Section 338), congress gave the president tariff authority.

    Basically, all SCOTUS did was conclude that the President checked the wrong statutory box by relying on IEEPA rather than another statute to impose these tariffs. And indeed, President Trump has already switched gears here with an EO announcement on friday imposing, under other statute, a ’10 percent global tariff under Section 122 over and above our normal tariffs already being charged.’ like he had done under the IEEPA. So the real looser in this case was the left wingers, because in effect their case made SCOTUS verify that the president does indeed have tariff power under statute (which is outlined in the Kavanaugh dissent) so overall even this SCOTUS loss was a Trump win.
