“En banc” means the entire complement of judges in the 9th Circuit. Thus, there’s no concern about the draw of judges when ALL of them are hearing the case.

Nevertheless, I do share your concern about the outcome. We haven’t managed to correct the 9th Circuit’s excesses completely yet, although I hope Trump can do that before his term is up.

As just one example of Leftist/fascist idiocy, Bonta’s ‘Golden State’, which wishes to prohibit ‘open carry’ because it will terrorize children, is ‘policed’ by CHP/state troopers, county sheriff’s deputies, city police who ALL openly carry. Haven’t noticed any horrified, fleeing crowds running away from the local cops or the state troopers.

Bonta’s insane rhetoric just capsulizes what the Leftist/fascists REALLY want – only the gummint should have guns. ‘Cause we all KNOW how ‘well-trained’ and ‘reliable’ THEY are, amirite???

Unfortunately, history shows that the Ninth Circuit will almost certainly grant en banc rehearing, and will then use all sorts of chicanery to stack the draw of judges hearing it, as Judge Van Dyke has extensively documented. And then they will simply ignore the law to reach a preordained result.

They have gotten away with it for years, and until SCOTUS grows a pair and cracks down on this blatant lawlessness, it will continue. But unfortunately, as ACB’s comments at the trans-athletes oral argument last week demonstrated in spades, ACB has apparently succumbed to Beltwayitis, and thus I fear we no longer have a majority willing to do so.

Let's all remember why Jerry Brown (per his own press statement) nixed our open carry here in CA back in 2012: He said he made the decision out of concern for public safety due to poorly trained LEOs mistakenly shooting law-abiding open carriers. So the Governor who removed our open carry was doing because of the State's concern for the actual misbehavior of law enforcement, and the current Governor wants to keep that liberty from us from a stated concern of the potential misbehavior of the victims of that law enforcement. Clown world.
