The President determines that unlawful obstruction, insurrection, or refusal/inability of the state to protect federally guaranteed rights justifies federal intervention; or

Other statutory criteria under the Insurrection Act are met. Note: The Insurrection Act permits deployment of federal troops for law enforcement functions that would otherwise be barred by the Posse Comitatus Act.

You’re wrong again, Miner. He has the authority to deploy the Guard under specific circumstances. He’s enforcing the existing laws on the books. There’s a process to change those laws if you don’t like them. You don’t change them by violently attacking federal employees trying to do their jobs, or by murdering people you don’t agree with.
