malum prohibitum == &quot;something is bad merely because government says so&quot; (which is completely arbitrary of course)
-- versus --
malum en se == &quot;something is bad because everyone inherently knows it to be bad&quot; (which includes crimes that are obvious to everyone and therefore require no official laws such as stealing, rape, and murder)

The problem with malum prohibitum laws is that governments can declare literally anything to be illegal and therefore jam-up anyone and everyone who have not harmed anyone and who have/had no intention of harming anyone.]]></description>
