Arguments that day start at 8:30 AM Eastern.   This one is the fourth case on the docket for that panel that morning, so I&#039;d estimate that this argument would start between 10:30-11:00 AM Eastern.   However, if one of the cases in front of this one on the docket is decided without argument (unusual but does sometimes happen), then his case moves up on the schedule and so it might start earlier.   Arguments typically take about 45 minutes (Appellant goes first, followed by appellee, followed by appellant&#039;s rebuttal, with each side getting a total of 20 minutes).

The real question is what judges have been randomly assigned to the 3 judge panel that will hear and decide this case.  (Appellate courts typically keep that a secret until right before the argument to avoid gamesmanship.  Last time I argued a case at the Fourth Circuit, we didn&#039;t find out who was on our panel until a few minutes before oral argument).   The Fourth Circuit has taken a hard left turn over the past decade (due to Obama filling a lot of slots that the Bush II administration stupidly left unfilled, and Biden appointing a slew of real nutjobs), and so there is no shortage of rabidly anti-2A judges on that court.   But there are still some sane ones, and hopefully they will draw at least one of them on the panel.]]></description>

It&#039;s an appellate *argument*.   There is no testimony or evidence presented at such hearings: an appeal is based on the evidentiary record established in the court below, and the argument is the chance for the parties to re-urge the points made in their briefs and for the Court to ask questions about them.  That&#039;s it.

And federal appellate courts do release the audio of the oral argument, usually the afternoon of the argument (and some offer livestreams).   But none have or offer video.]]></description>
