					<description><![CDATA[This is not an opinion, the content is not up for debate. He illegally sold at least 150 firearms, some found in the hands of children and convicted criminals. He signed forms for firearms purchases stipulating that they would not be resold and then resold the firearms. Each charge can carry 20 years. He sold in quantities which require a dealers license. He sold at gun shows. He was even taking orders. Undercover federal agents purchased three from Malinowski at central Arkansas gun shows. Malinowski would purchase guns through legal means, checking off a box on the purchase form that he was buying the gun for himself. He would then resell the just-purchased guns in as little as 24 hours through gun shows where he maintained a table or through private sales. In one case, he was reported to have told an undercover buyer that all purchases were cash only. There were 10 carloads of officers and agents on the scene. The affidavit also shows the search warrant is related to a violation of dealing in firearms without a license and unlawful acquisition. Some of his sales have recorded Time To Crime (TTC) in as few as 15 days from his date of purchase.

The prosecuting attorney, Will Jones, concluded they were justified based on evidence including a Little Rock Police Department&#039;s Mobile Video Recorder. Not only did they announce themselves, they turned on a patrol vehicle&#039;s lights and siren while doing so. It’s also been said that agents shut off the electricity to the home before beginning the raid, but Jones dispensed with that rumor: “A records subpoena to Entergy revealed that there was no disruption of service to the home on March 19,” his letter says. Ms. Malinowsky stated that they “were awake in their bedroom when they heard knocking at the door,”.

Having announced themselves for nearly 30 seconds before entry, with the lights and siren of a patrol car turned on, the agents entered while carrying a large ballistic shield with ATF POLICE in big letters on the front, and Mr. Malinowsky fired 4 shots. The attorney for the Malinowsky estate stated that he fired at a decidedly low angle from approximately 30 feet away (below the shield), shooting one officer in the lower leg.

Federal law allows individuals to sell up to four firearms per year without obtaining a FFL. Some states may have additional regulations and restrictions on the sale of firearms. You can sell at a gun show, but the buyer must go through a licensed dealer for a background check. You can sell to individuals from another state, but the transaction must be conducted through a licensed dealer in the buyer’s state.

Affidavit: MALINOWSKI stated he sells at gun shows in Benton (Arkansas), Conway (Arkansas), and at a music hall in Memphis (Tennessee). MALINOWSKI stated he sells out of AR pistols, like the ones he had on display, very quickly at the Memphis gun show.

The warrant being served was in pursuant to violations of;

They didn&#039;t have actual probable cause for an arrest, if they had they would have had an arrest warrant. They needed the search warrant to search for evidence to get probable cause for an arrest, but note also on the search warrant application they also did not check the box for the reason for the search as &#039;arrest&#039;. They set up this search purposely for &#039;no knock&#039; exactly how they did it. No knock search warrants have to be authorized for no-knock, this one was not authorized for such. 

They raided this mans home on basically a fishing expedition, didn&#039;t use proper procedures, no wait time before forcing entry, and no announcement they were law enforcement. It looked exactly like a home invasion. There were armed and ready and willing to kill, that is evidenced by the firepower and swat team they bought along - you don&#039;t do that unless you are ready and willing to kill. The victim wasn&#039;t a high risk target, no evidence what so ever of a violent person or a person who would flee. The ATF deliberately created the conditions that looked exactly like a criminal home invasion. They could have approached him at any time, even outside his home while he was getting in the car to go to work and serve their search warrant. Instead the ATF, with a fishing expedition search warrant that was not authorized for no-knock, and in hours of darkness, decides to create the very conditions under which a person would be prompted to defend their home. 

They essentially murdered this man, and even if he had done something wrong it wasn&#039;t enough to warrant such a response. It doesn&#039;t matter what the ATF claims he did, that still has to be proven that he intended to do that or that it was even actually a crime and there is plenty of doubt that a lot of what the ATF claims was an actual crime. The ATF with basically &#039;we say so&#039; and using made up definitions literally essentially murdered an innocent man.]]></description>

If they&#039;re in charge of videoing themselves, then they&#039;ll only show you what they want to show you. The rest will be hidden from view in the name of protecting sources and methods. Yeah right.

The feds did the same thing, taping over and unplugging security cameras, when the FBI raided the African People&#039;s Socialist Party. The Feds hiding what they do is their official MO. Democrats cheer when the Fed Govt flexes on any opponent of the Regime, but they&#039;ll trash the local PD in a heartbeat if there&#039;s an identity angle to divide the country with, even if it&#039;s based on lies.
