IIRC, govt agents can be individually sued if they act beyone their authority. Intentiopnally violating agency policies and procedures is not within the authority delegated to individual govt employees.

You may recall the story of Bryan Malinowski, the Arkansas airport executive that was gunned down [i.e. ‘murdered’, ‘wrongfully killed’] by ATF agents in March of 2024. Washington Gun Law President, William Kirk, discusses the newly filed lawsuit by the surviving members of the family which alleges that the ATF far exceeded necessary force, failed to comply with their own regulations, and are responsible for the wrongful death of Mr. Malinowski. This lawsuit has some teeth and this will be a good test for the new and improved ATF and DOJ.
